国务院办公厅政府信息与政务公开办公室关于明确政府信息公开与业务查询事项界限的解释
国办公开办函〔2016〕206号

国土资源部办公厅：

《关于不动产登记资料依申请公开问题的函》（国土资厅函〔2016〕363号）收悉。经研究，并经征求国务院法制办公室、最高人民法院的意见，答复如下：

不动产登记资料查询，以及户籍信息查询、工商登记资料查询等，属于特定行政管理领域的业务查询事项，其法律依据、办理程序、法律后果等，与《政府信息公开条例》所调整的政府信息公开行为存在根本性差别。当事人依据《政府信息公开条例》申请这类业务查询的，告知其依据相应的法律法规规定办理。
